Patna: Residents in apartments of Bihar will have to stick to the rules stipulated by the concerned flat owners’ society, which will be set up in accordance with the model bye-laws formulated by the state cooperative department. Those violating rules framed and duly approved by the societies will have to pay the penalty up to ₹2000 and one year of jail.
The state cooperative department has finalised the draft bye-laws for setting of the apartment owners’ societies, stipulating mandatory maintenance charge, norms for cleanliness, provision for periodic health check-up, blood donation camps, etc. The flat owners will have to register their societies with the state cooperative department and elect the officials for a period of five years.

Officials said that every apartment need to form the maintenance committee and fix the maintenance charge to be levied on each flat owners in lieu of providing common facilities, maintenance of lift, cleanliness in common areas, household waste disposal, etc. As per the bye-laws, each flat owners will have to pay same maintenance charge, and those not paying the amount could be penalised.
The proposed bye-laws mandate every flat owner society shall have 13-member committee, and reservation norms will have to follow in the constitution. The chief executive shall be ex-officio director. The committee shall meet at the interval of every three months or four times in a year. The chairman shall be elected by the director’s council. The committee shall have six members (three each members male and female) from unreserved categories, two (male and female) from the scheduled castes, two from backward castes and two from the extremely backward castes.

Officials of the cooperative department said that the flat owners’ management committee shall be constituted immediately after their registration. However, they required to be constituted through elections within twelve months under the supervision of the state election authority. The elected body shall have the tenure of five years.
There are around 2 lakh apartments in the state, of which nearly 15,000 are located in Patna.
